签定劳动合同必须盖企业公章吗？有什么法律规定？

劳动和同的生效要件之一就是双方当事人必须签字、盖章，没有用人单位的公章劳动合同是无效的。
但合同上如果有用人单位法定代表人的签字，且合同具备劳动合同的的内容并且双方已经实际履行，
则该合同则可以成为劳动者维护自己合法权益的依据。劳动部门的鉴定不是劳动合同生效的必要条件，
劳动合同只要双方意思一致，并签字盖章，且劳动合同内容不违反法律规定，即可生效。
私人聘用合同只要具备劳动合同的生效要件就是有效的，并不以是否鉴定为生效与否的要件。
